Colombian Porn Star Wins Legal Battle Against Meta
Meta deleted porn star Esperanza Gómez's Instagram account. Now, Colombia's highest court has ruled that the company violated the woman's freedom of expression by doing so, reports BBC.
The 45-year-old Colombian, Esperanza Gómez, who is a porn actress, had over five million followers on Instagram. She stated that she posted photos of herself in underwear as "part of her work."
However, Meta, which owns Instagram, recently deleted her account after claiming she violated the company's rules on nudity. Gómez took Meta to court over this.
On Friday, Colombia's Constitutional Court announced that the tech giant removed Esperanza Gómez's account "without a clear and transparent justification." It ruled that social media posts are protected by Colombia's constitution and can only be restricted proportionately when necessary.
"Inconsistent Application of Nudity Rules"
In its decision, the court wrote that Meta "applied its rules on nudity and sexual services inconsistently" as other accounts with similar content were allowed to remain.
Meta was ordered to "review and adjust Instagram's terms of use and privacy policy so that users are clearly informed" about the company's rules regarding this type of content.
It is unclear whether Gómez will receive any form of financial compensation after winning against Meta.
